Vice President Yemi Osinbajo has said that the Presidency would resend Ibrahim Magu's name to the senate for confirmation as EFCC Chairman after 2 rejections.
Speaking to journalists in Aso Rock yesterday he said: "I am fully in support of Magu as EFCC Chairman and so is the President. If our candidate is rejected, the law says we can re-present him", Osinbajo said. "Even a pocket book lawyer knows that the constitution overrides the EFCC Act. The EFCC Act says the presidency has to send the name of the EFCC nominee to the senate for confirmation. The constitution states otherwise," he continued. "There was no need, in the first place, to have sent Magu to the senate for confirmation", Osinbajo declared, hinting that the executive will rely on the prerogative powers of the President in matters like this, to keep Magu in his seat in perpetuity.

Mr. Ibrahim Magu, Acting Chairman of the Economic and Financial Crimes Commission (EFCC) escaped death by the whiskers as some gunmen stormed his house in Abuja. They killed one of the police guards attached to the house and disappeared after they couldnt find Mr. Magu
According to reports, the gunmen stormed the farmhouse in Karshi in the Federal Capital Territory at about 10pm and exchanged fire with the policemen on duty.
A police Sergeant was hit and he died instantly.
This is the second time that the same house will be attacked by unknown elements.
Following threats, security was beefed up for Magu and his immediate family leading to the deployment of policemen to the uncompleted bungalow in Karshi.
Some suspected elements had also been prowling the family’s house in the Borno State capital and issuing threats to the woman.
This latest attack came barely 48 hours after Magu said the anti-corruption will be a do-or-die affair.
Speaking on Monday after a walk to mark the anti-corruption Day, Magu said: “For those of us on this side; in the anti-corruption agencies of government, in the media, and civil society, the dagger is drawn and I believe I am speaking the mind of everyone on this side that we intend to neither retreat nor surrender in our noble intention to cure our country of the evils of corruption.
“For us as a country, the fight against corruption is a ‘do or die’ affair; we have to win the battle or die trying.

EFCC denies issuing warrant for Maina’s arrest ïżŒ

The Economic and Financial Crimes Commission  on Thursday denied issuing a bench warrant for the arrest of the ex-Chairman of the Presidential Pension  Reform Task Force, Mr. Abdul-Rasheed Maina.  The EFCC stated this in a counter-affidavit deposed to by one of its litigation officers, Yusuf Musa, at the Federal High Court, Kaduna.  The commission, in the counter-affidavit,  described as false  a claim  by Maina that the anti-graft agency had issued a warrant for his  arrest.  Maina,  in a written address in support of a summons he filed at the court on Wednesday, was seeking a perpetual injunction restraining the EFCC from arresting him.  Besides the EFCC, other defendants in the suit filed by the former PPRTF boss at the Federal High Court are the Attorney General of the Federation, the Senate President and the Speaker of the House of Representatives.  The EFCC in its counter-affidavit said Maina’s claim was untrue, adding that  it did not issue a bench warrant against or for his arrest.  The counter-affidavit partly read, “That paragraph 4(g) of the plaintiff’s affidavit is denied as false because the 1st defendant has no power to issue a bench warrant and has not issued any bench warrant against or for the arrest of the plaintiff.” The anti-graft commission noted that it would be in the interest of justice for the court not to grant a perpetual order restraining it from carrying out its lawful duties. “That it will be in the interest of justice to refuse and dismiss the plaintiffs originating summons for lacking in merit,” the agency said.

In the suit he filed at the Federal High Court also in Kaduna against the EFCC, AGF, the Senate President and Speaker, House of Representatives, Maina challenged the legality of the EFCC to declare him wanted.

EFCC/DSS clash: Senate grills Magu, Daura, others in secret ïżŒ

The Senate ad hoc committee set up to investigate the November 21, 2017, showdown between officials of the Department of State Services and the Economic and Financial Crimes Commission in Abuja began its investigative hearing on Thursday behind closed doors.

In attendance at the hearing were the Director General, Department of State Services, Mr. Lawal Daura; Acting Chairman, EFCC, Mr. Ibrahim Magu; and Acting Director General, NIA, Mr. Mohammed Dauda.

Daura, Magu and Dauda, who were at the venue long before members of the committee arrived and sat far apart, did greet each other.

Magu was accompanied by officials of the EFCC deployed for the attempted arrest of the immediate past Director-General of the DSS, Mr. Ita Ekpenyong; and former Director-General, NIA, Ambassador Ayo Oke, on November 21, which were prevented by DSS operatives.

The probe was similar to an earlier one by the Senate into the controversial reinstatement of former Chairman of the Presidential Task Force on Pension Reforms, Abdul-Rasheed Maina, into the service of the Federal Government.

The panel, chaired by Senator Emmanuel Paulker, had conducted its investigative hearings behind closed doors but the House of Representatives conducted the same probe on a live broadcast.

Chairman of the committee, Senator Francis Alimikhena, after his opening remarks at the hearing on EFCC/DSS clash, asked if any of the heads of the agencies in attendance had any observations or questions.

The NIA and EFCC bosses said they had none but the DSS boss asked that the hearing be conducted in camera.

Daura said, “I will like to seek or ask the distinguished committee whether our testimonies will not be given in the presence of the press.” Alimikhena agreed with the DSS boss, saying, “I know. Good. We have gone through all your (written) presentations and we have seen all your papers. The matter is of security importance to this country. The Senate and indeed Nigeria want settlement and more cooperation between the three security agencies of this country.

Alleged N5.3bn fraud: Nnamani seeks perpetual injunction against EFCC ïżŒ

A former governor of Enugu State, Dr. Chimaroke Nnamani, has urged the Federal High Court in Lagos to perpetually restrain the Economic and Financial Crimes Commission from inviting, arresting or further prosecuting him in connection with a criminal charge involving an alleged fraud of N5.3bn.

In an application brought on Thursday before Justice Chuka Obiozor, Nnamani, through his lawyer, Shamsudeen Abubakar, from the chambers of Mr. Rickey Tarfa (SAN), sought an “order of perpetual injunction restraining the complainant/respondent whether by itself, agent, privies or any other person deriving power, command, authority, instruction or directive from the complainant/respondent from inviting, interrogating, investigating, arresting, maintaining or otherwise prosecuting the accused person in respect  of the offences contained in Charge No: FHC/L/09C/2007 – Federal Republic of Nigeria Vs. Chimaroke Nnamani & Ors – in its original or amended form.” The ex-governor, who is said to be bedridden in a United States hospital, also urged the judge to set aside the warrant issued for his arrest last week.

In the application, Nnamani said he had already entered into a plea bargain with the Federal Government during which the companies charged along with him forfeited their assets.

He said his lawyers advised him to take the step in view of his health.

The ex-governor stated that he underwent a major heart surgery abroad in 2003. “In view of the 1st accused/applicant’s inability to stand trial without jeopardising his life in the process, he was advised by his lawyers to consider settling outside of court in order to adequately take care of his grave ill health.” The ex-governor alongside his erstwhile aide, Sunday Anyaogu, and six companies were charged with alleged N5.3bn fraud in 2007.

On March 25, 2015, Justice Mohammed Yunusa, who was handling the case, granted an application by the EFCC to try Nnamani and Anyaogu separately from the six companies.

Counsel for the EFCC, Kelvin Uzozie, hinged the application on the fact that the case was not moving.

FG to hand over 40 contractors to EFCC for prosecution ïżŒ

The Minister of Niger Delta Affairs, Usani Usani, on Wednesday said his ministry had compiled the list of about 40 erring contractors that would be sent to the Economic and Financial Crimes Commission for investigation and prosecution.

He said the contractors were those handling different projects, including the East -West Road, awarded by the ministry.

Usani spoke with State House correspondents at the end of a meeting of the Federal Executive Council presided over by Vice-President Yemi Osinbajo.

He said, “Right now, I have compiled names of some of these contractors and I am sending them to the EFCC, not just for the East-West Road. “I have got a minimum of 30 to 40 contractors that I am sending to the EFCC. On the East-West Road, I have taken a private consultant to review the whole cost, so, some contractors will obviously refund money for which the present cost will be discounted. “So, when you see contractors ganging up and publishing things against me, you should know the foundation. But as far as I am here, I will do something that I feel is right.” The minister alleged that the East-West Road was designed to fail.

He however promised that the present administration would correct the defect. “The East-West Road is a project that has been messed up from inception, naturally designed to fail by all the agreements and designed concepts that we have seen. “Here we are, making sure that we put things in order so that we can see the terminal point of that project. “If the project started more than a decade ago and in 24 months, we have made the progress we have made on that project, correcting even the construction deficits in the area, then I think you should be able to appreciate what we are doing,” he said.

The minister also disclosed that the council approved N16bn for the construction of the headquarters of the Niger Delta Development Commission.

He said the building, which would be sited in Port Harcourt, Rivers State, would be completed within 52 weeks.

Gunmen invade Magu’s house, kill policeman ïżŒ

Unknown gunmen on Tuesday night invaded an unoccupied house of the Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Ibrahim Magu.

It was learnt that the gunmen stormed the house located within a farm owned by Magu in Karshi, a suburb of Abuja, at about 10:00 p.m.

The attackers subdued a police officer and another civilian working on the property and tied them up before beating the duo to a pulp. “The policeman died from the beating,” a source close to the EFCC boss’ family disclosed.

The motive behind the attack is, however, said to be hazy as the attackers carted away five cattle and some sheep that were being reared in the compound.

Meanwhile, attempt to reach Magu and EFCC spokesman, Wilson Uwujaren, to react to this story was not successful at the time of this report.

The farmstead had been placed under police security a few months ago following an attack on it in which the uncompleted house was ransacked in suspicious circumstances.

The attack on the property was also followed not long afterward by a dawn attack on the EFCC office in Abuja in August. “That was what warranted additional security around Magu and his family,” the source explained.

Ikoyi whistle-blower jets out as FG pays first tranche of his N421m reward
.
The whistle-blower, who helped the EFCC recover the $43m, N23.2m and ÂŁ27,800 (N13bn) from an Ikoyi apartment on April 12, 2017, has finally been paid his commission, Punchng reports. .
.
It was also learnt that the whistle-blower travelled out of the country less than 24 hours after receiving part of the N421m reward. The whistle-blower’s lawyer, Mr. Yakubu Galadima, confirmed the development on Wednesday. .
.
He praised the government for finally honouring its agreement after eight months. He, however, said his client had not been paid in full, adding that the FG had promised to pay him the balance next year. .
.
The N13bn recovered from the Osborne Towers was said to have been part of the $289,202,382 the NIA received from the Central Bank of Nigeria in February 2015. .
.
The transaction was purportedly approved by former President Goodluck Jonathan through the embattled former National Security Adviser, Col. Sambo Dasuki (retd.). .
.
On paper, the transaction was known as an intervention fund for national security or special services with the aim of fighting insurgency during the six weeks period between February 14 and March 28 after the election was postponed. .
.
However, the operatives of the EFCC believe that the money was meant to finance the 2015 general elections. No one has, however, been prosecuted till date.
